These general conditions of sale define the rights and obligations of the parties in the context of distance sales made on the site belonging to the company EDIM: www.convertiblecenter.fr

Distance selling is subject to European Union law and French positive law.

Civil law in its articles 1101, 1108 is binding on the parties with regard to the formation of the contract.

Convertible Center informs its customers that in accordance with article 1108-1 of the civil code, any order placed is a legal act within the meaning of the Law and that the parties undertake to respect their reciprocal obligations.

Convertible Center informs its customers that in accordance with the meaning of articles 1316-1 and 1316-4 of the Civil Code, "writing in electronic form is admissible as evidence in the same way as writing on paper, provided that the person from whom it originates can be duly identified […]"

Once an order has been validly formed within the meaning of common law, the parties are bound to each other:

Convertible Center undertakes to deliver a compliant product within the time limits indicated and except in cases of force majeure within reasonable time limits according to a jurisprudential definition on the one hand, and on the other hand the customer undertakes to pay the price.

The parties undertake to perform their mutual obligations with complete loyalty and in good faith.

Distance sales are subject to certain rules required by consumer law, in particular, the customer acknowledges having read, prior to validation of the order, these general conditions of sale which he acknowledges having read and accepted with full knowledge of the facts before the formation of the contract.

Convertible Center may be required to adapt and/or modify these terms and conditions when required by law and reserves the right to adapt or modify these general terms and conditions of sale at any time. The publication of the general terms and conditions of sale is immediately applicable.

The photographs and visuals of the products presented on the site have no contractual nature.

The last update date of the general conditions of sale is indicated at the bottom of this page.

Article 1 – Legal majority

By validating these general conditions when ordering, the customer declares that they have the legal capacity to enter into a contract, i.e. to be of legal age and not to be under guardianship or curatorship.

Article 2 - The order:

Distance sales are subject to certain rules required by consumer law, in particular, the customer acknowledges having read, prior to validation of the order, these general conditions of sale which he acknowledges having read and accepted with full knowledge of the facts before the formation of the contract.

The order can only be registered on the site if the customer has clearly identified himself by entering his email address and password. The customer can place his order online from the references of the offers visible on the site.

Final validation of the order occurs after confirmation of payment by the means of payment made available to the customer.

After placing an order, Convertible Center will send the customer an acknowledgement of receipt by email, including a summary of the items ordered, their prices which are expressed in euros including tax and the delivery address.

Convertible Center reserves the right to modify its sales prices in the event of an increase in charges, in particular the VAT rate, and in the event of a manifest error.

In application of the Decree of July 20, 2005 relating to the elimination of waste from this equipment, Convertible Center will add to the sale price of the products concerned an environmental contribution called “ECO-PARTICIPATION” collected on behalf of the organization responsible for recovery and recycling.

Article 3 - Payment:

The customer can choose to pay for your order:

By bank transfer: By making a bank transfer indicating our RIB/IBAN information which will be communicated to you in your order confirmation. If the product is in stock at the time of ordering, the product will be reserved for you for a period of 10 days. Beyond this period and without receipt of your transfer, we will not be able to reserve your items for you any longer.

By check: By sending your check by mail to the address that will be communicated to you in your order confirmation. If the product is in stock at the time of ordering, the product will be reserved for you for a period of 10 days. Financing your order in 3 or 4 times by credit card from 849 € of purchases up to 4000 € with ALMA

Our partner ALMA offers you a financing solution in 3 or 4 installments without fees, or 10 installments with fees which allows you to pay for your purchases from €849 to €4,000 with your bank card.

Terms :

This offer is reserved for individuals (adult natural persons) whose order is intended to be delivered in France, Belgium and Luxembourg and who hold a Visa, MasterCard and American Express bank card with a validity date greater than the duration of the chosen financing.

Systematic authorization cards, particularly Electron, Maestro, Nickel, etc., as well as e-cards and Indigo cards, are not accepted.

Unless proven otherwise, the data recorded by ALMA constitutes proof of all transactions between you and ALMA.

If you request to benefit from a financing solution offered by ALMA, the information relating to your order will be transmitted to ALMA, which will use it for the purposes of studying your request for the granting, management and recovery of the payment facility.

ALMA reserves the right to accept or refuse your request for financing in 3x 4x ALMA.

Payment in 2 installments without fees by bank card is a payment solution that allows you to spread the payment of your order over 2 installments debited from your account associated with your bank card.

2) Financing in 10x from 829 € of purchase up to 4,000 € with Alma

CONVERTIBLECENTER.FR offers you the possibility to pay for your order in 10 installments by credit card from €149 to €4,000 with ALMA.

Conditions: This dedicated credit offer is reserved for individuals (adult individuals) holding a Visa, MasterCard or American Express bank card, with a validity date greater than the duration of the chosen financing. Systematic authorization cards, in particular Electron, Maestro, Nickel, etc., as well as e-cards and Indigo cards, are not accepted.

Subscription terms: After completing your order, simply select the payment method “Financing in 10 times by credit card”. You will then be redirected to the ALMA website, our partner, displaying the detailed summary of your order and the personalized financing request, which you must then validate.

You will need to enter your personal information, you will read the general terms and conditions of the 10-installment payment that you wish to subscribe to which are provided to you in PDF format so that you can read them, before accepting them. You then notify your acceptance by electronic signature. Unless proven otherwise, the data recorded by ALMA constitutes proof of all transactions between you and ALMA.

If you request to benefit from a financing solution offered by ALMA, the information relating to your order will be transmitted to ALMA, which will use it for the purpose of studying your application for the granting, management and recovery of credit. ALMA reserves the right to accept or refuse your request for financing in 10 times by credit card.

How it works: Financing in 10 installments by credit card allows you to pay for the order placed on our Site as follows:

a mandatory contribution, debited on the day of confirmation of your order corresponding to the percentage of the order and the first monthly payment

a payment schedule for the remainder of the order amount over the remaining 9 monthly payments,

A loan commits you and must be repaid. Check your repayment capacity before committing. Payment in 10 installments by credit card is a payment solution that allows you to spread the payment of your order over 10 installments debited from the account associated with your credit card. The fees amount to 5.25% of the order. Example: for a purchase of €999, you pay 1 installment of €105.21 and 9 installments of €105.16. Total financing amount: €1,051.65. Fees: €52.65. Maximum financing duration: 10 months.

Payment: Payment by credit is available for the settlement of their purchases via our partner Alma, the execution of the payment is conditioned by the signing of the credit agreement proposed by Alma. The Seller accepts in advance the granting of credit concluded between Alma and the customer in accordance with Article L312-46 of the Consumer Code. If Alma agrees to grant credit to the customer, the amount will be paid by credit in accordance with Article L312-45 of the Consumer Code. Any refusal by Alma to grant credit for an order may result in the cancellation of the order, unless the customer agrees to pay in cash. Any termination of the General Terms and Conditions binding the Seller and the customer, results in the termination of the credit agreement between Alma and the customer. In the event of withdrawal, the Customers' costs and interest will be reimbursed in accordance with the regulations.

Security: Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure. Alma is a telepayment manager and issues an electronic certificate that will serve as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the Civil Code.

The credit is granted by the company Alma, a company with capital of €316,226.83, RCS Nanterre 839 100 757, ACPR approved under No. 90789 - Contact: support@getalma.eu.

Convertible Center is a credit indicator in accordance with the provisions of R.519-2, 1° of the Monetary and Financial Code.

Convertible Center distributes advertisements sent by Alma relating to the granting of credit by Alma.

For orders by transfer, check and by ALMA, the delivery commitment will also take effect upon validation of the payment after notification by you of the transfer or confirmation of the support of the ALMA Credit organization.

Convertible Center cannot be held responsible for any additional delivery delay due to late payment.

Also, it is your responsibility to act diligently to allow us to process your order and to respect the deadline indicated for information purposes, Convertiblecenter.fr cannot be held responsible for delays in delivery arising from an external cause beyond its control, such as a delay due to a strike by one of its service providers or any other cause external to the company presenting an unforeseeable and irresistible character in accordance with a jurisprudential definition.

Packages can be shipped to mainland France, Corsica, Belgium and Luxembourg.

These conditions only apply to non-commercial natural persons aged at least 18 years and having the legal capacity to contract.

3) Credit from 12 to 36 months with Younited Pay

EDIM offers its customers the Younited credit service for the settlement of their purchases and the execution of the payment. This is conditional on the customer's acceptance of the credit agreement proposed by Younited.

EDIM (n°ORIAS 18000485) acts as a non-exclusive agent in banking operations for Younited. EDIM assists in carrying out credit operations without acting as a lender.

Any refusal by Younited to grant credit for an order may result in its cancellation.

Any termination of the General Terms and Conditions which bind the customer and EDIM results in the termination of the credit agreement between Younited and the customer.

The amount is paid by a credit granted by Younited registered on REGAFI under number 13156, approved as a credit institution by the Prudential Control and Resolution Authority (ACPR) - 4 Place de Budapest - CS 92459 - 75436 PARIS CEDEX 09 - www.acpr.banque-france.fr ).

Article 4 - Home delivery:

Delivery is made to your home by appointment by one of our transport providers depending on the delivery method chosen (with or without installation).

When making an appointment, the customer must inform the carrier of any access difficulties (floor, doorway size, staircase width, etc.) that the delivery people may encounter and must ensure the accessibility of the products ordered. Any additional costs related to the rental of a lift, storage or taking incorrect measurements and any risk of damage resulting from these constraints will be borne by the CUSTOMER.

Upon delivery with installation, the packaging is generally taken back. However, it is strongly recommended to keep it in case of return of the product.

In the case of delivery without installation, the goods will be placed at the foot of the truck and will not be unpacked under any circumstances.

In the event of a proven or unforeseen absence of the customer for a delivery with an appointment, an error in the delivery address or telephone number, or an accessibility problem at the location preventing delivery, Convertible Center may charge you for a new delivery.

Convertible Center undertakes to deliver items in stock as quickly as possible by one of its carriers.

If the goods have suffered damage during transport, the customer must systematically issue precise handwritten reservations on the nature of the problem on the delivery note. In the absence of reservations, the delivery will be deemed to comply with the order and the customer will bear any loss related to the anomalies and/or damage noted.

Delivery is considered to be in accordance with the order from the moment the customer accepts the package without making any reservations on the delivery slip and is presumed to have been delivered complete and in good condition.

In case of any problem, we advise our customers to inform us within a maximum of 48 hours after delivery, otherwise no claim can be made to the delivery services concerned. Contact us

Please note: The words “Subject to unpacking” have no legal value.

If the goods are too damaged, the customer must refuse the package and contact customer service to arrange a new shipment of the order.

Article 5 - Site security:

Article 6 - Right of withdrawal for contracts concluded remotely and returns:

1. Withdrawal period:

We understand that doubt is a part of life and that buying a sofa bed or furniture online can be a difficult choice. That's why you benefit from the clause: 14 days of satisfied or refunded trial from the date of receipt of your order. If the product you have chosen is not perfect for you or if you simply change your mind, you can contact us and we will take care of taking it back. If you wish to withdraw, you must imperatively make your request by email .

Your order must not show any wear or signs of use. The refund will be made once the goods have been collected and checked by our services. We will then refund the full amount paid, excluding return costs, which will remain your responsibility. This period may be extended if the recovery of the goods in question takes longer (Article L221-24)

The refund will be made within a maximum of 14 days from the date on which you informed us of your wish to withdraw. This period may be extended if the recovery of the item in question takes longer (Article L221-24).

"The consumer's liability may only be incurred in the event of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these goods, provided that the professional has informed the consumer of his right of withdrawal, in accordance with 2° of Article L. 221-5."

The withdrawal period does not apply to in-store purchases. Furthermore, the customer is advised that pursuant to Article L 221-28 of the Consumer Code, the right of withdrawal cannot be exercised, in particular, for contracts: For the supply of goods made to the consumer's specifications or clearly personalized. (special dimensions and fabrics outside the standard collection).

It follows that the right of withdrawal cannot be exercised for products ordered and manufactured at the customer's request, either to measure; it being specified that a product to which one or more elements of a quality different from its original quality and which have been ordered by the customer (foam density, dimensions, design, color, non-standardized coverings) are considered to be made to measure, compared to the products offered in one of our stores or on the website www.convertiblecenter.fr.

The withdrawal period does not apply to purchases made in store.

For hygiene reasons, unpacked or used mattresses are not returned.

2. The return:

The product must be returned new without any signs of wear or use, in its original packaging, with all the provided documentation and accessories included. Therefore, if you return incomplete, damaged or damaged items to us, you will be charged a recommissioning fee. Products too damaged by customers to be usable will not be accepted.

Subject to the returned product being in perfect condition, Convertible Center is required to reimburse the sums paid by the customer with the exception of the return costs remaining the responsibility of the customer.

Convertible Center undertakes to refund within 14 days of receipt of products returned by the customer or collected by our carrier.

Article 7 - Return of products:

Bulky products:

For purchases delivered to your home, CONVERTIBLE CENTER will take back, free of charge, your old product, whether CONVERTIBLE CENTER products or other brands, under the following conditions:

You will need to indicate your return request when ordering, specifying the dimensions of the product to be returned, which must be identical

The used product must be of the same nature and quantity as the product purchased and delivered. (We will not be able to take back a fixed sofa free of charge if we deliver a convertible sofa, nor a leather sofa if you order a fabric sofa or a 3-seater sofa if you order a 2-seater sofa)

The returned product must be completely dismantled and packed by you in one or two packages maximum (knowing that a package must not exceed 30 kg).

Unable to return the used product:

If the return conditions indicated to the customer are not respected, the delivery person may refuse to take charge of the used product.

Article 8 - Guarantees:

Independently of the commercial guarantee, and in accordance with the regulations, Convertible Center undertakes to respect its obligations relating to the guarantees attached to the products sold on its site in accordance with the provisions of the Consumer Code and the Civil Code.

1) Legal guarantee of conformity

Article L.217-4 of the Consumer Code:

The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility under the contract or has been carried out under his responsibility.

Exception: Article L.217-8 of the Consumer Code:

The buyer is entitled to demand that the goods conform to the contract. However, he cannot contest conformity by invoking a defect that he knew about or could not have been unaware of when he contracted. The same applies when the defect originates in the materials that he himself supplied.

Implementation of the conformity guarantee: Article L.217-9 of the Consumer Code:

In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods. However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is manifestly disproportionate to the other method, taking into account the value of the goods or the significance of the defect. The seller is then required to proceed, unless impossible, according to the method not chosen by the buyer.

2) Legal guarantee against hidden defects

Article 1641 of the Civil Code:

The seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.

Article 1642 of the Civil Code:

The seller is not liable for apparent defects of which the buyer has been able to convince himself.

Article 1648 of the Civil Code:

The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.

3) Commercial guarantee

Scope of application:

The commercial and legal guarantee is 2 years but can be extended to 5 years for certain products on the website www.convertiblecenter.fr


Daily sleeping mattress - 5-year warranty

Our everyday mattresses come with a 5-year warranty that lasts
account of the degradation of the product over time, which is why it is
degressive and is established as follows:

  • 100% guarantee for the first 2 years
  • 70% guarantee for the 3rd year
  • 50% guarantee on the 4th year
  • 20% guarantee on the 5th year

These guarantees do not include delivery costs from the 3rd year.


Slatted mechanism - 5-year warranty

Our mechanics benefit from a 5-year warranty which takes into account
the degradation of the product over time, which is why it is degressive
and is established as follows:

  • 100% guarantee for the first 2 years
  • 70% guarantee for the 3rd year
  • 50% guarantee on the 4th year
  • 20% guarantee on the 5th year

These guarantees do not include delivery costs from the 3rd year

Under the commercial warranty, Convertible Center undertakes to exchange or repair only the defective element or part.


Warranty Exclusion:

The implementation of the warranty assumes that the after-sales service has recognized that the part is defective due to a hidden defect.

Interventions and replacements of spare parts carried out by Convertible Center under the warranty do not extend its duration.

The said commercial guarantee is excluded in the following cases:

Deterioration and damage that are not attributable to Convertible Center, such as: Incorrect assembly/assembly, abnormal use (misuse or handling), repeated disassembly and reassembly. Use of the product in conditions other than those for which they were designed.

Damage or accidents resulting from impact, fall, negligence, lack of supervision or maintenance, damage due to corrosion.

Fabric problems in the event of: Accident, tearing due to abnormal use (misuse, intensive use, professional use, cigarette burns, scratches and damage caused by pets).

The commercial warranty does not apply to discoloration or color changes due to normal weather conditions.

Article 10 - Personal information and protection of personal data:

In accordance with the provisions of Law No. 78-17 of 6 January 1978, as amended, relating to information technology, files and freedoms with regard to the automated processing of personal data, as well as Regulation (EU) No. 2016/679 of 27 April 2016.

We use your personal data to provide you with a good relationship in compliance with the Data Protection Act.

- E-Mail: We only send you information with your permission. If you have given us your consent, you may receive messages by e-mail, so that you can be kept informed of our news, our offers, promotions, competitions and to let you discover our new collections.

Article 11 - Mediations:

In accordance with Article L.612-1 of the Consumer Code, the consumer, subject to Article L.612.2 of the Consumer Code, has the option of submitting a request for amicable resolution by means of mediation, within a period of less than one year from the date of his written complaint to the professional.

The company EDIM has designated, by membership registered under number 80372/MJ/2303, SAS Médiation Solution as a consumer mediation entity.

- Copy of the prior complaint,

- All documents allowing the instruction of the request (purchase order, invoice, proof of payment, etc.)

As such and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code.
