These general conditions of sale define the rights and obligations of the parties in the context of distance sales made on the site belonging to the company EDIM: www.convertiblecenter.fr

Distance selling is subject to European Union law and French positive law.

Civil law in its articles 1101, 1108 is binding on the parties with regard to the formation of the contract.

Convertible Center informs its customers that in accordance with article 1108-1 of the civil code, any order placed is a legal act within the meaning of the Law and that the parties undertake to respect their reciprocal obligations.

Convertible Center informs its customers that in accordance with the meaning of articles 1316-1 and 1316-4 of the Civil Code, "writing in electronic form is admissible as evidence in the same way as writing on paper, provided that the person from whom it originates can be duly identified […]"

Once an order has been validly formed within the meaning of common law, the parties are bound to each other:

Convertible Center undertakes to deliver a compliant product within the time limits indicated and except in cases of force majeure within reasonable time limits according to a jurisprudential definition on the one hand, and on the other hand the customer undertakes to pay the price.

The parties undertake to perform their mutual obligations with complete loyalty and in good faith.

Distance sales are subject to certain rules required by consumer law, in particular, the customer acknowledges having read, prior to validation of the order, these general conditions of sale which he acknowledges having read and accepted with full knowledge of the facts before the formation of the contract.

Convertible Center may be required to adapt and/or modify these terms and conditions when required by law and reserves the right to adapt or modify these general terms and conditions of sale at any time. The publication of the general terms and conditions of sale is immediately applicable.

The photographs and visuals of the products presented on the site have no contractual nature.

Article 1 – Legal majority

By validating these general conditions when ordering, the customer declares that they have the legal capacity to enter into a contract, i.e. to be of legal age and not to be under guardianship or curatorship.

Article 2 - The order:

Distance sales are subject to certain rules required by consumer law, in particular, the customer acknowledges having read, prior to validation of the order, these general conditions of sale which he acknowledges having read and accepted with full knowledge of the facts before the formation of the contract.

The order can only be registered on the site if the customer has clearly identified himself by entering his email address and password. The customer can place his order online from the references of the offers visible on the site.

Final validation of the order occurs after confirmation of payment by the means of payment made available to the customer.

After placing an order, Convertible Center will send the customer an acknowledgement of receipt by email, including a summary of the items ordered, their prices which are expressed in euros including tax and the delivery address.

Convertible Center reserves the right to modify its sales prices in the event of an increase in charges, in particular the VAT rate, and in the event of a manifest error.

In application of the Decree of July 20, 2005 relating to the elimination of waste from this equipment, Convertible Center will add to the sale price of the products concerned an environmental contribution called “ECO-PARTICIPATION” collected on behalf of the organization responsible for recovery and recycling.

Article 3 - Payment:

Terms :

CONVERTIBLECENTER.FR offers you the possibility to pay for your order in 10 installments by credit card from €149 up to €4,000 with ALMA.

Conditions: This earmarked loan offer is reserved for individuals (adults) holding a Visa, MasterCard, or American Express bank card with an expiry date beyond the chosen financing period. Cards requiring systematic authorization, such as Electron, Maestro, Nickel, etc., as well as e-cards and Indigo cards, are not accepted.

Subscription details: After completing your order, simply select the payment method "Financing in 10 installments by credit card". You will then be redirected to the ALMA website, our partner, displaying a detailed summary of your order and the personalized financing request, which you must then validate.

You will need to enter your personal information. How it works: Financing in 10 installments by credit card allows you to pay for your order placed on our Site as follows:

a mandatory deposit, debited on the day your order is confirmed, corresponding to a percentage of the order and the first monthly payment

a payment plan for the remaining amount of the order, spread over the 9 remaining monthly installments.

A loan is a commitment and must be repaid. Check your repayment capacity before committing. Paying in 10 installments by credit card is a payment solution that allows you to spread the cost of your order over 10 installments debited from the account associated with your credit card. The fee is 5.25% of the order. Example: for a purchase of €999, you pay 1 installment of €105.21 and 9 installments of €105.16. Total financing amount: €1051.65. Fee: €52.65. Maximum financing term: 10 months.

Payment: Credit payment is available for purchases made through our partner Alma. Payment is contingent upon signing the credit agreement offered by Alma. The Seller accepts in advance the credit agreement concluded between Alma and the customer in accordance with Article L312-46 of the French Consumer Code. If Alma agrees to grant credit to the customer, the amount will be paid by credit in accordance with Article L312-45 of the French Consumer Code. Any refusal by Alma to grant credit for an order may result in its cancellation, unless the customer agrees to pay in full. Any termination of the General Terms and Conditions of Sale (GTC) between the Seller and the customer will result in the termination of the credit agreement between Alma and the customer. In the event of withdrawal, the customer's fees and interest will be reimbursed in accordance with applicable regulations.

Security: Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure. Alma manages online payments and issues an electronic certificate that serves as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the French Civil Code.

Convertible Center is a credit indicator in accordance with the provisions of R.519-2, 1° of the Monetary and Financial Code.

Convertible Center distributes advertisements sent by Alma regarding Alma's credit offerings.

For orders by bank transfer, check and ALMA, the delivery commitment will also take effect upon validation of payment after notification by you of the transfer or confirmation of the taking of charge by the ALMA Credit organization.

Convertible Center cannot be held responsible for any additional delivery delays due to late payment.

Therefore, it is your responsibility to act diligently to allow us to process your order and to respect the time frame indicated for information purposes, Convertiblecenter.fr cannot be held responsible for delivery delays arising from an external cause independent of its will such as a delay due to a strike at one of its service providers or any other cause external to the company which is unforeseeable and irresistible in accordance with a legal definition.

Parcel shipments can be made to mainland France, Corsica, Belgium, and Luxembourg.

These conditions only apply to non-commercial natural persons, aged at least 18 years and having the legal capacity to contract.

3) 24 to 36 month loan with Younited Pay

EDIM offers its customers Younited's credit service for the payment of their purchases. This is conditional upon the customer's acceptance of the credit agreement offered by Younited.

EDIM (ORIAS registration number 18000485) acts as a non-exclusive agent for Younited in banking operations. EDIM assists in the execution of credit transactions without acting as a lender.

Any refusal by Younited to grant credit for an order may result in the cancellation of that order.

Any termination of the terms and conditions that bind the customer and EDIM results in the termination of the credit agreement between Younited and the customer.

The amount is paid by a loan granted by Younited, registered on the REGAFI under number 13156, authorized as a credit institution by the Prudential Control and Resolution Authority (ACPR) - 4 Place de Budapest - CS 92459 - 75436 PARIS CEDEX 09 - www.acpr.banque-france.fr ).

Article 4 - Home delivery:

Delivery is made to your home with an appointment arranged by one of our transport providers depending on the delivery method chosen (with or without installation).

From the 5th floor onwards, without an accessible elevator, €30 per floor are to be paid to the delivery company (by check or cash).

When scheduling a delivery appointment, the customer must inform the carrier of any access difficulties (floor, doorway size, stair width, etc.) that the delivery personnel may encounter and must ensure the accessibility of the ordered products. Any additional costs related to lift rental, storage, or incorrect measurements, and any risk of damage resulting from these constraints, will be borne by the customer.

When delivery includes installation, packaging is usually taken away. However, it is strongly advised to keep it in case the product needs to be returned.

In the case of a delivery without installation, the goods will be left at the foot of the truck and will not be unpacked under any circumstances.

In the event of a proven or unforeseen absence of the customer for a scheduled delivery, an error in the delivery address or telephone number, or a problem with the accessibility of the location preventing delivery, Convertible Center may charge you for a new delivery.

Convertible Center is committed to delivering in-stock items as quickly as possible via one of its carriers.

If the goods have been damaged during transport, the customer must systematically make specific handwritten reservations about the nature of the problem on the delivery note. In the absence of such reservations, the delivery will be deemed to conform to the order and the customer will bear all costs related to the anomalies and/or damage observed.

Delivery is considered to conform to the order from the moment the customer accepts the package without making any reservations on the delivery slip and is presumed to have been delivered complete and in good condition.

In case of any problem, we advise our customers to inform us within 48 hours of delivery; otherwise, no claim can be made to the delivery service. Contact us

If the merchandise is too damaged, the customer must refuse the package and contact customer service to arrange for a new shipment of the order.

Article 6 - Right of withdrawal for distance contracts and returns:

1. Withdrawal period:

We understand that doubt is a part of life and that buying a sofa bed or other furniture online can be a difficult decision. That's why you benefit from a 14-day money-back guarantee, starting from the date you receive your order. If the product you've chosen isn't perfect for your home or if you simply change your mind, you can contact us and we'll take it back. If you wish to cancel your order, you must submit your request by email .

Your order must show no signs of wear or use. The refund will be processed once the merchandise has been received and inspected by our team. We will then refund the full amount paid, excluding return shipping costs, which remain your responsibility. This timeframe may be extended if the return of the item takes longer than expected (Article L221-24).

The refund will be issued within a maximum of 14 days from the date on which you informed us of your wish to withdraw. This period may be extended if the recovery of the item in question takes longer (Article L221-24).

"The consumer can only be held liable for any depreciation of goods resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of those goods, provided that the professional has informed the consumer of their right of withdrawal, in accordance with point 2 of Article L. 221-5."

The right of withdrawal does not apply to in-store purchases. Furthermore, the customer is advised that, pursuant to Article L 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised, in particular, for contracts concerning the supply of goods made to the consumer's specifications or clearly personalized (special dimensions and fabrics not included in the standard collection).

It follows that the right of withdrawal cannot be exercised for products ordered and manufactured at the customer's request or made to measure; it being specified that a product is considered made to measure, in relation to the products offered in one of our stores or on the website www.convertiblecenter.fr, if one or more elements of a different quality than its original quality will be removed or added and which will have been ordered by the customer (foam density, dimensions, design, color, non-standardized coverings).

The right of withdrawal does not apply to purchases made in-store.

For hygiene reasons, unpacked or used mattresses and mattress and pillow protectors cannot be returned.

2. The return:

The product must be returned in new condition, without any signs of wear or use, in its original packaging, with all accompanying documentation and accessories. Therefore, if you return incomplete, damaged, or defective items, you will be charged a restocking fee. Products that are too damaged by the customer to be usable will not be accepted for return.

Subject to the returned product being in perfect condition, Convertible Center is required to reimburse the sums paid by the customer, with the exception of the return costs which remain the responsibility of the customer.

Convertible Center is committed to issuing refunds within 14 days of receiving products returned by the customer or collected by our carrier.

Article 7 - Return of products:

Bulky products:

For purchases delivered to your home, CONVERTIBLE CENTER will take back your old product, whether it is a CONVERTIBLE CENTER product or another brand, free of charge, under the following conditions:

You will need to indicate your wish to return an item when placing your order, specifying the dimensions of the item to be returned, which must be identical.

The used product must be of the same type and quantity as the product purchased and delivered. (We cannot take back a fixed sofa free of charge if we deliver a sofa bed, nor a leather sofa if you order a fabric sofa, nor a 3-seater sofa if you order a 2-seater sofa.)

The returned product must be completely disassembled and packed by you in one or two packages maximum (knowing that a package must not exceed 30 kg).

Unable to return the used product:

If the return conditions indicated to the customer are not respected, the delivery person may refuse to take charge of the used product.

Article 8 - Guarantees:

Regardless of the commercial warranty, and in accordance with regulations, Convertible Center undertakes to respect its obligations relating to the warranties attached to the products sold on its site in accordance with the provisions of the Consumer Code and the Civil Code.

1) Legal guarantee of conformity

Article L.217-4 of the Consumer Code:

The seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was the seller's responsibility under the contract or was carried out under the seller's supervision.

Exception: Article L.217-8 of the Consumer Code:

The buyer has the right to demand that the goods conform to the contract. However, they cannot contest conformity by invoking a defect that they knew of or could not have been unaware of when they entered into the contract. The same applies when the defect originates from materials that they themselves supplied.

Implementation of the conformity guarantee: Article L.217-9 of the Consumer Code:

In the event of a lack of conformity, the buyer may choose between repair and replacement of the goods. However, the seller may refuse the buyer's choice if it entails a cost that is clearly disproportionate to the other option, taking into account the value of the goods or the significance of the defect. In such a case, the seller is obligated to proceed, unless impossible, according to the option not chosen by the buyer.

2) Legal guarantee against hidden defects

Article 1641 of the Civil Code:

The seller is bound by the warranty against hidden defects in the thing sold which render it unfit for the use for which it is intended, or which diminish this use to such an extent that the buyer would not have acquired it, or would have given only a lower price, if he had known of them.

Article 1642 of the Civil Code:

The seller is not liable for apparent defects which the buyer could have discovered for himself.

Article 1648 of the Civil Code:

The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.

3) Commercial warranty

Scope:

The standard commercial and legal warranty is 2 years but can be extended to 5 years for certain products available on the website www.convertiblecenter.fr


Mattress for everyday use - 5-year warranty

Our mattresses for everyday use come with a 5-year warranty that covers
taking into account the product's degradation over time, that's why it is
degressive and is established as follows:

  • 100% guarantee for the first 2 years
  • 70% guarantee on the 3rd year
  • 50% guarantee on the 4th year
  • 20% guarantee on the 5th year

These guarantees do not include delivery charges from the 3rd year onwards.


Slatted mechanism - 5-year warranty

Our mechanical components come with a 5-year warranty that takes into account

Under the terms of the commercial warranty, Convertible Center undertakes to exchange or repair only the defective item or part.


Warranty exclusion:

The implementation of the warranty assumes that the after-sales service has acknowledged that the part is defective due to a hidden defect.

Interventions and replacements of spare parts carried out by Convertible Center under the warranty do not extend its duration.

This commercial warranty is excluded in the following cases:

Damage and deterioration not attributable to Convertible Center, such as: incorrect assembly/mounting, abnormal use (misuse or mishandling), repeated disassembly and reassembly, or use of the product under conditions other than those for which it was designed.

Damage or accidents resulting from impact, falls, negligence, lack of supervision or maintenance, damage due to corrosion.

Problems with fabric in case of: Accident, tearing due to abnormal use (misuse, intensive use, professional use, cigarette burns, scratches and damage caused by pets).

The commercial warranty does not cover discoloration or color changes due to normal weather conditions.
